Leave it to Pierre Poilievere to try to make political hay from the outrage over the decision to transfer murderer and rapist Paul Bernardo from maximum security to a medium security facility.
Poilievre is now suggesting that the Prime Minister mandate that all mass murderers such as Bernardo must always be kept in a maximum security facility. That should resonate with angry voters.
It seems to be another attempt by Poilievre to make up policy on the run to try to tap into public anger.
The problem is that Poilievre’s idea is borrowed from the pages of the Get Tough on Criminals legislation put forth by his former boss, Stephen Harper.
It’s worth noting that most of those laws were tossed out by the Supreme Court as violations of the Charter or Rights, but, then, why would Poilievre let that fact get in the way of a good rant?
I’m not a Constitutional lawyer, but I think that our Constitution draws some pretty clear lines between the authority of the legislative and judicial branches of our government.
I think moving Bernardo is absolutely wrong, but let’s not try to right a wrong with another wrong.
How and where a convicted criminal should serve their sentence should be determined by a qualified judge, not the Prime Minister.
